01Agreeing to these terms

By using Dialed Control you agree to these terms. If you do not agree, please do not use it.

Dialed runs several websites and each has its own terms, which apply to that site. Where you use more than one, the terms of the site you are on apply there. How we handle personal information is in the Privacy Policy.

02Who we are

Dialed is an independent project run by Dialed LLC. We are not affiliated with, endorsed by or sponsored by Focus V or Puffco. Product names are trademarks of their respective owners, and we name them only to say what our software and services work with.

In these terms, "we", "us" and "Dialed" mean Dialed LLC, which runs Dialed, Dialed Control and Dialed Works.

03Who can use it

Dialed is about vaporizer devices. You must be at least 21 years old, or older if that is the legal age where you live, to use anything we offer.

You are responsible for following the laws that apply to you, including those about the products these devices are used with. Do not use Dialed where doing so is illegal.

04What this website is

This is the Dialed Control website, which describes our independent firmware and web app for Focus V devices. It is informational and has no accounts.

The web app where you actually connect a device, sign in and install firmware has its own terms: Dialed Control web app terms. The firmware itself is covered by the sections below and by those terms.

05Beta software and closed firmware

Dialed Control is in beta: it is unfinished, changes often, and can have faults.

Firmware images are closed to the public while we test. Access is by invitation, through the Dialed Discord and the web app. We can grant, refuse or withdraw access at any time.

Do not share, mirror, publish or resell firmware images, or try to get around the access controls.

06Your device, your risk

Dialed firmware changes the software on your device. It is not made, approved or supported by the manufacturer. The manufacturer's warranty may not cover problems that custom firmware causes (we do not control it), and installing it can stop your device working. We build in checks before an install and a way back to factory firmware, but we cannot promise they will work on every device and every situation.

These devices get hot. Heating only starts when you start it, but you are responsible for it: stay with it while it heats, keep it away from children, pets and anything flammable, and do not use settings you do not understand. Stop a session at any time with the device's own button.

Nothing we publish is medical, legal or safety advice.

07Acceptable use

Do not use Dialed Control to break the law, to harm anyone or anyone's device, or to harass people.

  • Do not try to break, overload, scan or probe our systems, or to get around limits, access controls or rate limits.
  • Do not scrape or copy it in bulk, or use it to build a competing service from our work.

08Links and other services

We link to services we do not run, such as Discord, Terpline and the social pages of glass makers. Their own terms and policies apply when you use them, and we are not responsible for them.

09Our content

The Dialed name and logo, our designs, text, software and firmware belong to us or are used with permission. You may view and use Dialed Control for your own purposes. Do not use the Dialed name or logo in a way that suggests we endorse or are connected to you.

10No warranty

Dialed Control is provided "as is" and "as available", without promises of any kind: not that it will always work, be free of faults or suit your purpose, and not that it will work with your particular device, firmware version or phone or computer. Some places do not allow some of these exclusions, and then the law of the place decides.

11Limits on our responsibility

To the extent the law allows, we are not liable for indirect or consequential loss, lost data, or damage to a device, and our total liability for anything connected with Dialed Control is limited to the amount you paid us for the thing the claim is about in the 12 months before it. If it was free, that amount is nothing.

Nothing in these terms limits anything that cannot be limited by law, including your legal rights as a consumer where you live.

12Changes, suspension and ending

We can change, pause or stop Dialed Control, or any part of it, at any time.

You can stop using it whenever you like.

We may update these terms. The date at the top shows the latest version, and if a change matters we will make it clear. Using Dialed Control after a change means you accept the new terms.

13Governing law

These terms are governed by the laws of the US state in which Dialed LLC is organized, without regard to its conflict-of-laws rules. If you are a consumer, this does not take away protections that the law of the place where you live gives you and that cannot be waived.

14Contact

Dialed LLC runs Dialed Control. For legal and privacy matters, email legal@dialed.diy. For anything else, email contact@dialed.diy. You can also open a ticket in the Dialed Discord (Beta & access, Bug report or General all work). We reply by the same route.
